Trademarks
A thorough, nationwide trademark search should be conducted prior to spending too much time and money on creating your business name, logo, and brand identity. We can assist you with a search to determine the strength of your current business name and logo, file your trademark application, and monitor it until registration. We believe predictable billing practices provide you with much-needed certainty in your budget. Our trademark services are offered through flat-fee (or fixed) prices. For most services, you will know the amount of your bill before we start.
Trademark Package for the name of your business (Word Mark)
We will schedule a phone, Teams (video), or in-person meeting to learn more about your business and brand. After the meeting, we will conduct a thorough trademark clearance search and analysis and provide you with an opinion letter about possible conflicts or challenges. If your chosen name appears registerable and you use the mark in commerce, we will collect and create USPTO-acceptable mark specimens. We will research applicable classes related to your goods or services to ensure that filing is in the proper class. Then, we will complete the trademark application and file it on your behalf. This package includes filing one trademark application with USPTO for one class of goods or services and includes responses to non-substantive requests. This includes responses to requests for disclaimers, clarifications on meaning or translations, ownership information, or questions concerning colors or elements of the applied-for-mark. We will continue to monitor your trademark application until registration. After registration, if you choose, we will request a certified copy of the registration document for you to display. **The filing fees to USPTO are due when we file your application. After completing the application, we will send you a link to sign the application and pay the filing fees digitally. The current USPTO fees are $250 or $350, depending on the complexity of the trademark. The fee to the USPTO for a certified copy of the registration certificate is $25. To get started, click here. Filing of the Statement of Use
If you file a Section 1(b), Intent to Use application, you must file a Statement of Use within six months of filing. To discuss our process and learn about your brand, we will schedule a meeting via phone, Teams (video), or in person. After the meeting, we will assist in collecting and creating USPTO-acceptable specimens to show use in commerce. We will draft and file a Statement of Use. **The filing fee to USPTO is due when we file your application. After completing the application, we will send you a link to sign the application and pay the filing fee digitally. The current USPTO fee is $100.

Filing of the 6-Month Extension for Statement of Use
If you are not ready to file the Affidavit of Use within six months, you must file an extension. After a brief meeting to discuss the process, we will draft and file the Request for a 6-Month Extension. We will calendar your next due date and send you a reminder to file your Statement of Use. *The filing fee to USPTO is due when we file your application. After completing the application, we will send you a link to sign the application and pay the filing fee digitally. The current USPTO fee is $125.

Office Action Responses

Send a Cease-and-Desist Letter
Stop other businesses from infringing your mark. We will meet with you to understand your concerns. After discussing your concerns, we will research the offending mark and draft a letter alleging trademark infringement. We will send the letter by certified mail to the opposing party. Includes one discussion with the opposing party or opposing party's counsel. If unable to settle or no response is received, an additional retainer will be requested to cover ongoing legal fees and litigation costs. Additional time will be billed at $200/h. Respond to a Cease-and-Desist Letter
Respond to accusations that you are infringing on another business’s mark. We will schedule a meeting to discuss the infringement allegations. After the meeting, we will research the allegations and the opposing mark. If there is a legal basis to defend your use, we draft a response letter refuting the allegations and presenting any defenses. We will send the letter by certified mail. Filing Trademark Renewal § 8 (5 Year)
Renewal is due between the 5th and 6th years of trademark registration. Renewal confirms the use of your mark in commerce. We will schedule a meeting to discuss the renewal. We collect and create USPTO-acceptable specimens, draft the trademark renewal and declaration forms, and file them on your behalf. **The filing fee to USPTO is due when we file your application. Filing Trademark Renewal § 8 and § 15 (5 Year)
Renewal is due between the 5th and 6th years of trademark registration. § 8 declaration confirms use in commerce. § 15 (Declaration of Incontestability) conveys additional benefits making it more difficult to cancel your registered mark. We will schedule a meeting to discuss the renewal. We will collect and create USPTO-acceptable specimens, draft the trademark renewal and declaration forms, and file them on your behalf. **The filing fee to USPTO is due when we file your application. After completing the application, we will send you a link to sign the application and pay the filing fee digitally. The current USPTO fee is $425 per class. ($225 for § 8 and $200 for § 15). Filing Trademark Renewal § 8 and § 9 (10 Year)
Renewal is due between the 9th and 10th years of trademark registration. § 8 declaration confirms use in commerce. § 9 renews the trademark for ten years. We will schedule a meeting to discuss the renewal. We will collect and create USPTO-acceptable specimens, draft the trademark renewal and declaration forms, and file them on your behalf. **The filing fee to USPTO is due when we file your application. After completing the application, we will send you a link to sign the application and pay the filing fee digitally. The current fee is $525 for one class. ($225 for § 8 and $300 for § 9).
